Licensed Application End User License Agreement

This Licensed Application End User License Agreement ("Agreement") is a binding legal agreement between you (an individual or a single entity) and Design Token ("Licensor") for the Travel Currency Exchange CURRENCY FX PRO application ("Licensed Application"), which you have obtained through the Apple App Store.

By downloading, installing, or using the Licensed Application, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not download, install, or use the Licensed Application.

1. Scope of License

1.1. Subject to your compliance with the terms of this Agreement, Licensor grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download, install, and use the Licensed Application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions
• Access and use the Licensed Application on such devices strictly in accordance with the terms and conditions of this License Agreement

1.2. This license does not allow you to use the Licensed Application on any device that you do not own or control, and you may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time.

2. Subscription Services

2.1. The Licensed Application offers the following Auto-Renewable Subscription plans:

• Weekly Premium: $0.99 USD per week
• Annual Premium: $9.99 USD per year

2.2. Auto-Renewal: Your subscription will automatically renew at the end of each subscription period unless you cancel it at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

2.3. Payment: Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions may be managed by you and auto-renewal may be turned off by going to your Account Settings after purchase.

2.4. Free Trials: If a free trial is offered, any unused portion of the free trial period will be forfeited when you purchase a subscription.

2.5. Cancellation: You may cancel your subscription at any time through your Apple ID account settings. Cancellation will take effect at the end of the current billing period.

3. Restrictions

3.1. You agree not to, and you will not permit others to:

• License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the Licensed Application
• Modify, make derivative works of, disassemble, decrypt, reverse compile or reverse engineer any part of the Licensed Application
• Remove, alter or obscure any proprietary notice (including any notice of copyright or trademark) of Licensor or its affiliates, partners, suppliers or the licensors of the Licensed Application

4. Intellectual Property Rights

4.1. All rights, title, and interest in and to the Licensed Application, including all intellectual property rights therein, are and will remain the exclusive property of Licensor and its licensors. The Licensed Application is protected by copyright and other intellectual property laws and treaties.

4.2. All trademarks, service marks, trade names, logos, and other designations of source used in or displayed through the Licensed Application are the property of their respective owners.

5. Disclaimer of Warranties

5.1. THE LICENSED APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

5.2. Licensor does not warrant that the Licensed Application will be uninterrupted or error-free, that defects will be corrected, or that the Licensed Application or the server that makes it available are free of viruses or other harmful components.

5.3. IMPORTANT: The Licensed Application provides foreign exchange (FX) currency market information and analysis tools. This information is for informational purposes only and does not constitute investment advice, financial advice, trading advice, or any other type of advice. You should not treat any content as a recommendation to buy or sell currencies or any other financial instruments. Licensor is not a registered investment advisor or financial broker. Always consult with a qualified financial professional before making any trading or investment decisions.

6. Limitation of Liability

6.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE LICENSED APPLICATION, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

6.2. In no event shall Licensor's total liability to you for all damages exceed the amount of fifty dollars ($50.00).

7. Indemnification

You agree to indemnify, defend and hold harmless Licensor and its officers, directors, employees, agents and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from: (i) your use of and access to the Licensed Application; (ii) your violation of any term of this Agreement; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your use of the Licensed Application caused damage to a third party.

8. Privacy

Your use of the Licensed Application is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding the collection and use of your information.

9. Changes to this Agreement

Licensor reserves the right to modify this Agreement at any time. If we make material changes to this Agreement, we will notify you by updating the "Last updated" date at the top of this Agreement and, where appropriate, through the Licensed Application or other means. Your continued use of the Licensed Application after such modifications will constitute your acknowledgment of the modified Agreement.

10. Termination

10.1. This Agreement is effective until terminated by you or Licensor. Your rights under this Agreement will terminate automatically without notice from Licensor if you fail to comply with any term of this Agreement.

10.2. Upon termination, you must cease all use of the Licensed Application and delete all copies of the Licensed Application from your devices.

11. Severability

If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Licensor operates, without regard to its conflict of law provisions.

13. Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.

14. Entire Agreement

This Agreement constitutes the entire agreement between you and Licensor regarding the Licensed Application and supersedes all prior and contemporaneous agreements, proposals or representations, written or oral, concerning its subject matter.

By downloading, installing, or using Travel Currency Exchange CURRENCY FX PRO, you acknowledge that you have read this Agreement, understand it, and agree to be bound by its terms and conditions.
